In another display of people’s unity, indigenous peasant communities and advocates from the middle sector in Kalinga province banded together to put a stop to all corporate mining activities in the province.

TABUK, Kalinga (330 kms, north of Manila) — Indigenous peasant communities and advocates from the middle sector in Kalinga want to put a stop to all corporate mining operations in Kalinga province. The unity was arrived at during a summit held here during the first week of May. The summit also put to task the National Commission on Indigenous Peoples (NCIP) because of its negligence in the issuance of the free, prior informed consent (FPIC) to two exploration applicants covering the ancestral domains of Kalinga tribes.

As of January 31, this year, two exploration permit applications (ExPa) have been approved. The European Wolfland Resources, Inc. EP 0001-2004 covering 496 hectares in Magnao was approved in July 2004 while that of Makilala Mining Co. Inc. EP 003A-2006 with 1494 hectares in Pasil was approved in January this year. Phelps Dodge, an American corporation, reportedly has equity shares with Makilala Mining. (more…)

THE HEAD OF THE fact-finding body that investigated Australian mining operations on Rapu-Rapu Island yesterday said he would write a “strongly worded” letter to President Gloria Macapagal-Arroyo if she ignores the panel’s recommendation to stop mining on the island.
Sorsogon Bishop Arturo Bastes chaired a nine-member commission that looked into the Rapu-Rapu mining operations in Albay province following two incidents of tailings spills that residents had blamed for fish kills in their area.

“If she will not follow our recommendations, I will write a letter, a strongly worded letter … What is the use of having a study if she does not follow it?” the Roman Catholic prelate said in an interview over the Church-run Radio Veritas. (more…)

MALACAÑANG said yesterday that it can strike a balance between development of mining resources and environmental protection even as it came under fresh attack from a militant organization which accused President Arroyo of using the Rapu-Rapu Fact-Finding Commission (RRFFC) to mollify the Catholic Bishops Conference of the Philippines.

The Palace issued the statement shortly after rejecting the RRFFC’s recommendation to cancel the license of Lafayette Philippines Inc., owned by Australia’s Lafayette Mining Ltd., due to two mine tailings spills in Rapu-Rapu island off Sorsogon last year.

The commission also recommended a review of the liberalized mining law’s provisions on the ownership and management of mining firms and operations.

President Arroyo herself created the RRFFC, headed by Sorsogon Bishop Arturo Bastes, to look into the environmental impact, including reported fish kills, of Lafayette’s twin mine tailings spills.

The commission was created after the CBCP called for the repeal of the Mining Act in a pastoral letter issued last January. The CBCP said mining "destroys life."

Press Secretary Ignacio Bunye said the use of legal, political and technological resources can enable government to achieve the goal to balance the creation of jobs in the mining sector with strict environmental protection measures.

"We should not adopt the defeatist attitude of an either-or situation," Bunye said.
He said what is important is to maximize the country’s natural resources to alleviate poverty while ensuring the well-being of the communities.

"The Arroyo administration is for the full implementation of the Mining Act but always under strict implementation of environmental safeguards. Social justice can go hand in hand with economic growth," he said.

Pambansang Lakas ng Kilusang Mamamalakaya (Pa-malakaya) said Bunye’s assurance to foreign investors that the mining industry is still a government priority for development was tantamount to rejecting the RRFFC’s report.

"Malacañang merely exploited the Rapu-Rapu commission, (which) it created in vain try to please and calm down the protesting bishops of the Catholic Bishops Conference of the Philippines and the people staging a collective mass upheaval against Lafayette Mining. Now, Malacañang is singing the same pro-mining tune, despite the objective and collective report of the commission calling for Lafayette’s closure," Pama-lakaya chairman Fernando Hicap said.
The group urged Arroyo instead to file criminal and civil charges against Lafayette on the strength of the findings of the RRFFC.

"Malacañang should ready the charge sheet against Lafayette anytime this week. This is a make or break situation for Mrs. Arroyo and the rabid pro-mining group in the Palace," Hicap said.

Hicap said the government has to choose between the "interest of the people and the interest of its mining client in Australia."

"Will President Arroyo go against the anti-mining gospel of Bishop Arturo Bastes in favor of the multi-million peso commission of the Office of the President from Lafayette mining?" Hicap said.

"The ball is now in Malacañang’s court. The Filipino public is now waiting for the concrete and politically correct action that should be undertaken by President Gloria Macapagal-Arroyo in the name of public accountability and national interest," Hicap said.

Aside from recommending the scrapping of the environmental compliance certificate (ECC) issued to Lafayette for violating 11 of 29 conditions in its ECC, the Bastes Commission also proposed the creation of an independent mining authority that would monitor the effects of mining on people’s health and the environment.

Environmental group Green-peace said the RRFFC’s 169-page report upheld "environmental integrity and social justice over short-term economic benefits alleged by Australian firm Lafayette."

Greenpeace said they hope the President will listen to "the clamor of the people of Albay and Sorsogon to decide to keep the mines on Rapu-Rapu closed as the negative environmental, social and economic impacts to the communities far outweigh the alleged benefits."– Regina Bengco and Reinir Padua

Tampakan, South Cotabato—Sagittarius Mines Inc., the local partner of Indophil Resources NL, will expand the scope of a prefeasibility study to include areas adjacent to its mining development site.

Sagittarius president Paul Dominguez said the company was confident the government would continue to support sustainable mining practices in the country despite growing opposition from environmental groups.

“Antimining sentiments had tremendously heightened with a recent disaster that caused certain sectors to call for a moratorium on mining operations. However, we still believe that the government will continue supporting our cause as we give our assurance to go on with the project in a very sustainable manner using the best mining practices in the world,” Dominguez said. SEN. Jamby Madrigal on Sunday lashed out at Malacañang for disregarding the report of the fact-finding committee it created to look into the pollution in Rapu-Rapu, Albay, blamed on the mining operation of Lafayette Philippines Inc.

“Mrs. Arroyo, by disregarding her own independent commission report on the Lafayette mine-tailing incidents on Rapu-Rapu Island, proved that she really had no intention of honoring the commission’s report and findings. It was all for a show,” Madrigal said.
She accused the Arroyo administration of coddling Lafayette at the expense of the environment and the people.

The commission said it found the firm violated 11 of the 29 conditions of its environmental compliance certificate. (more…)

THE government has rejected the recommendation of a fact-finding commission to repeal the law liberalizing the mining sector. The commission, headed by Bishop Arturo Bastes of Sorsogon, was created by the President to investigate reports of pollution coming from a mine site in Rapu-Rapu, Albay.

The Bastes commission’s sweeping indictment of mining does not come as a surprise. The Catholic Church has been crusading against opening mining to foreigners, saying that it could only lead to the further destruction of the environment and the exploitation of indigenous people and communities. BUTUAN CITY — The Environment and Management Bureau (EMB) Caraga Region office said a mining consortium operating in this city can upgrade their permit for small scale mining to large scale mining operations.

EMB Chief of Environmental Impact and Monitoring Division Reynaldo S. Degamo issued this statement, explaining that along this line the “social acceptability” clause of the Mining Act is required.

This came amid concerns by environmental groups, saying any activities where environment and people’s lives are at stake, particularly mining, should be talked over with the affected communities. (more…)

GOVERNOR George Arnaiz junked all applications for gold and copper mining in Negros Oriental at a recent consultation in his office, said provincial legal officer Erwin Vergara.
Vergara said the governor’s decision followed the opposition aired by representatives of local government units, non-government organizations, and peoples’ organizations present at the meeting that discussed applications for gold and copper mining in the province.

He said the group had cited the destruction caused by past gold and copper mining operations in barangays Bayogan and Maglinao in the municipality of Basay, 125 kilometers from Dumaguete City. (more…)

ZAMBOANGA CITY — A Canadian mining firm TVI said Sunday it was supporting the stand of President Gloria Macapagal-Arroyo vis-à-vis the recommendations of the Bastes Commission.

Arroyo on Saturday turned down proposals to impose a total ban on mining after toxic spills at the Rapu-Rapu mining site run by the Australian firm Lafayette in Albay outside Manila.
The government vowed to strictly enforce laws and safety standards governing mineral exploration in the country and assured the public that it would carefully review and consider the 10 recommendations submitted by the Rapu-Rapu Fact-Finding Commission, headed by Bishop Arturo Bastes of Sorsogon.
